HUKUNCE-HUKUNCEN HAILA !!!
HAILA tana da hukunce-hukunce masu yawa fiye da guda 20 zamu ambaci wasu
abubuwa aciki wanda muke ganin anfi baqanta. Daga ciki akwai:
HUKUNCI NA FARKO: SALLAH ta haramta ga mai haila ta farilla ko ta nafila bata inganta
daga gareta, haka kuma sallah bata wajaba agareta, sai dai idan ta riski gorgodon
lokacin cikakkiyar raka'a daga lokacinta. To sannan ne sallah ta wajaba agare ta. Daidai
ne ta riski wannan ne daga farkon lokacinta ko qarshen lokacinta.
Misalin wannan a Mace haila yazo mata faduwar FARKON LOKACI: rana da gorgodon
raka'a guda to ya wajaba a gareta idan tayi tsarki ta rama sallar magrib domin ta riski
gorgodon raka'a guda a lokacinta kafin haola tazo mata.
Misalin wannan a KARSHEN LOKACIN: Mace ce jini ya dauke mata kafin rana ta qeto da
gorgodon raka'a guda to ya wajaba agareta idan tayi tsarki ta rama sallar asubah domin
ta riski wani yanki a lokacinta wanda zai isa ayi raka'a guda.

Saboda fadin Annabi (Sallallahu Alaihi Wa Sallam):
"Wanda ya riski raka'a acikin sallah to haqiqa ya riski sallar" [Bukhari da Muslim]
Abun fahimta anan shine duk wanda ya riski kasa da raka'a guda to bai riski sallah ba.
idan kuma ta riski raka'a daga lokacin sallar la'asar, shin ya wajaba a gareta tayi
sallar azahar tare da la'asar? Ko ta riski raka'a guda daga lokacin sallar isha, to shin ya
wajaba agareta tayi sallar magrib tare da isha?
Akwai sa6ani a tsakanin malamai game da wannan, amma abunda yake daidai shine,
babu abunda ya wajaba agareta sai abunda ta riska lokacinsa wato la'asar ko isha kawai.
Saboda fadin Annabi (sallallahu alaihi wasallam) "Duk wanda ya riski raka'a daya daga
sallar la'asar kafin rana ta fadi to haqiqa ya riski sallar la'asar" [Bukhari da Muslim]
Manzon ALLAH (Sallallahu Alaihi Wasallam) bai ce haqiqa ya riski Azahar da La'asar ba,
asali shine yake wajibi, wannan shine abunda Mazhabar Abu-hanifa da Imam maleek
suka gamu akansa an haqalto wannan acikin sharhin [Al-Muhazzab shafi na 3]
Amna zikiri da kabbara da tasbihi da tahmidi da yin bismillah yayin cin abinci da waninsa,
da karayun hadith da fiqihu da addu'a da fadan "Amiin" ga mai addu'a da jin karatun
Alqur'ani, duk babu abunda ya haramta ga (mai jinin haila) agareta daga cikin wadannan.
Haqiqa ya tabbata acikin sahihai guda 2 "Bukhari da Muslim" da wanin su cewa Annabi
(Sallallahu Alaihi Wasallam) Ya kasance yana kwanciya akan cinyar Aisha (Radiyallahu
anha) alhali tana haila kuma ya karanta alqur'ani.
Haka kuma dai acikin sahihai guda 2 daga Ummu Adiyya (Radiyallahu anha) cewa: ita taji
manzon ALLAH (Sallallahu Alaihi Wasallam) yana cewa tsofaffi da matan aure da masu
haila su fita (yana nufin sallar idi) su halarci alkhayri da addu'o'in muminai, masu haila su
nisanci wajen sallar idin"
Amma game da mai haila tayi karatu da kanta, shine idan ya kasance duba ne da idanu
ko aikatawa da zuciya ba tare da furtawa da harshe ba, to babu laifi da yin wannan.
Misali ta ajiye mushafin ko Allo (a gabanta) tana duban ayoyin tana karantawa da
zuciyarta (ba tare da ta dauki alqur'ani ba)
Imam Nawawy yace acikin sharhin Muhazzab. "Wannan ya halatta babu sa6ani, amma
idan ya kasance karatun nata ya zamo da furtawa da harshe to baki dayan malamai sun
tafi akan yin hani da wannan da rashin halaccinsa"
Bukhari da Ibn Jareer al-Dabariy da Ibnil Munzir sun ce: Ya halatta, kuma an haqalto daga
imam Maalik da imam shafi'i acikin wasu maganganun su, ya haqalto shi daga gare su
acikin fat'hul Bari [shafi na 408]
Bukhari ya ambaci ta'aliqi daga ibrahim al-Naka'I cewa: babu laifi ta karanta aya guda.
Sheikhul islam ibn Taimiyyah ya fada acikin fatawa wacce Ibn qasim ya tattara.
Babu wata sunnah ta asali a cikin hana (mace mai haila) karatun alqur'ani, haqiqa
fadinsa: kada mai haila ko mai janaba ta karanta wani abu daga alqur'ani, Hadith ne
rarrauna bisa haduwar masana hadith.
Haqiqa mata suna yin haila a zamanin Manzon ALLAH (Sallallahu alaihi wasallam) da
ace yin karatu haramun ne agare su kamar yadda aka haramta musu sallah, to da
wannan ya kasance daga abunda Annabi (Sallallahu alaihi wasallam) ya bayyana shi ga
al'ummarsa, ya kuma sanar dashi ga (matansa) iyayen muminai.
Saboda haka wannan abu ne kawai da ake jinsa daga mutane amma ba a samu wanda
ya ciro hani daga Annabi (Sallallahu alaihi wasallam) a game da hakan ba.
Bai kamata a haramta wannan ba tare da cewa ansan Annabi (Sallallahu alaihi wasallam)
bai yi hani a game da haka ba. Idan kuwa har bai hana ba tare da yawan masu haila a
zamaninsa to an san cewa ba haramun bane.
Abunda ya kamata muce bayan mun san sa6anin malamai a game da wannan shine:
Abunda yafi cancanta shine kada mai haila ta karanta alqur'ani ta hanyar furta
(harrufansa) da harshe, sai in buqatar hakan ta taso.
Misali: ta kasance malama ce saboda haka tana buqatar laqantawa wanda take koyarwa,
ko Daliba ce da take buqatar karantawa a halin jarrabawarta ko makamancin wannan.
HUKUNCI NA BIYU, AZUMI: Yin azumi ya haramta ga mai haila na farilla ko na nafila
bai inganta agare ta ba. Sai dai ya wajaba agareta ta rama na farilla, saboda hadisin
Aisha (R.A) tace: "Jinin haila ya kasance yana samun mu sai a umurce mu da rama
azumi amma ba a umurtar mu da rama sallah" [Bukhari da Muslim]
Idan haila tazo mata alhalin tana azumi to azuminta ya baci koda ya rage rana ta fadi da
gorgodon waigawar ido ne, kuma ya wajaba ta rama wannan azumi idan na fatilla ne.
Amma idan taji alamun zuwan jinin haila kafin fafuwar rana, sai kuma bai fito ba sai
bayan faduwar rana to azuminta cikakke ne a bisa mafi ingancin zance domin jinin yana
cikin ciki ne baza ayi hukunci da shi ba.
Domin Annabi (sallallahu alaihi wasallam) Yayin da aka tambaye shi a game da matar da
ta gani acikin baccinta irin abunda namiji yake gani shin zata yi wanka? Sai yace: eh idan
taga ruwa (Maniyyi)" sai ya rataya hukuncin da fitar maniyyi bada jin alamun fitarsa ba.
Haka ita ma haola hukuncin ta baya tabbata sai da ganin fitar jinin bada jin alamunsa ba.
Idan kuma alfijir ya qeto alhalin tana haila, to azumin wannan ranar bai inganta agare ta
ba koda tayi tsarki bayan qetowar alfijir da waigawar ido.
Amma idan jini ya dauke mata kafin qetowar alfijir kamar mai janaba ne, idan ya dauki
niyyar azumi alhali yana da janaba kuma bai yi wanka ba sai bayan qetowar alfijir. To
azuminsa ya inganta saboda hadisin Aisha (R.A) tace: "Manzon ALLAH (Sallallahu alaihi
wasallam) ya kasance yana wayar gari da janaba ta jima'i bata mafarki ba, sannan yayi
azumi acikin Ramadan" [Bukhari da Muslim]
HUKUNCI NA UKU, DAWAFI: Ya haramta agareta tayi dawafi (wato kewaye dakin
ALLAH) na farilla ko na nafila baya inganta daga gareta saboda fadin Annabi (sallallahu
alaihi wasallam) ga Aisha (R.A) cewa: "ki aikata duk abunda mai aikin hajji zai aikata sai
dai kada kiyi dawafi har sai kinyi tsarki"
Amma sauran ayyuka kamar su Sa'ayi a tsakanin safa da marwa da tsayuwar arfa da
kwana a muzdalifa daina da jifan jamra da wanin wannan daga ayyukan hajji da umrah
basa haramta a gareta.
Hakanan a halin tana da tsarki sannan tana gama yin dawafi sai haila tazo mata ko kuma
tana cikin yin sa'ayi to babu komai a gareta.
HUKUNCI NA HUDU: Sarayar da dawafin Bankwana a gare ta: idan mace ta gama yin
ayyukam hajji da umrah sannan haila tazo mata kafin ta fita zuwa garinta, har lokacin
tafiyarta garinsu yayi tana haila, to zata fita ba tare da tayi dawafin bankwana ba, saboda
hadisin ibn Abbas (R.A) yace: "An umurci mutane da ya kasance qarshen abinda zasu yi
shine dawafin bankwana, sai dai anyi rangwame ga mace mai haila" [Bukhari da Muslim].
Ba aso mace mai haila taje qofar masallacin harami yayin bankwana tayi addu'a, domin
ba a samo haka daga Annabi (sallallahu alaihi wasallam) ba. Ita kuwa ibada ana ginata
ne bisa abinda aka samu (daga gare shi) Sai ma dai an samu daga Annabi (sallallahu
alaihi wasallam) yana hukunci da sa6anin haka: A kissar Safiyyah (R.A) Yayin da Haila
tazo mata bayan tayi dawafi ifadha, cewa Annabi (sallallahu alaihi wasallam) yace da ita:
"ta nisanta (daga masallaci)" [Bukhari da Muslim]
Manzon ALLAH (sallallahu alaihi wasallam) bai yi umarni da zuwa qofar masallaci ba, da
kuwa yin haka shari'ah ne to da ya bayyana shi.
Amma yin dawafi na Hajji ko Umrah bai saraya akanta ba, zata bari ne tayi (ramuwar)
dawafin idan ta samu tsarki.
HUKUNCI NA BIYAR, Zama acikin Masallaci: Ya haramta har masallacin idi ya haramta
mace (mai jinin haila) ta zauna acikin sa. Saboda Hadisin Ummu-Adiyya (R.A) cewa: taji
Manzon ALLAH (Sallallahu alaihi wasallam) yana cewa: "Tsofaffi da matan aure da masu
Haila su fita (idi) aciki akwai masu haila su nisanci (filin sallar idi) [Bukhari da Muslim]
HUKUNCI NA SHIDA, Jima'i: Ya haramta mijinta yayi jima'i da ita (tana jinin haila),
haka ita ma ya haramta ta bashi wannan damar saboda fadin ALLAH Ta'ala: "suna
tambayarka game da jinin haila, kace shi qazanta ne, saboda haka ku nisanci mataye a
lokacin (da suke) haila, kada ku kusance su har sai sunyi tsarki" [Suratul Baqara aya ta
222]
Abinda ake nufi da haila shine zamanin haila da bigirensa shine farji. Saboda fadin
Annabi (sallallahu alaihi wasallam): "ku aikata kowane abu banda aure (yana nufin
jima'i)" [Muslim ne ya ruwaito]
Haqiqa dukkan musulmai sun hadu a bisa haramcin saduwa da mai haila ta farjinta.
Baya halatta ga mutumin da yayi imani da ALLAH da ranar lahira ya aikata wannam
al'amari abinqi wanda hani ya tabbata daga littafin ALLAH da sunnar Manzon ALLAH da
kuma haduwar dukkan musulmai. (Idan yayi haka) sai ya kasance daga cikin wadanda
suka sa6awa ALLAH da Manzonsa (sallallahu alaihi wasallam) kuma yabi tafarkin da ba
na muminai ba.
Yace acikin Majmu'u sharhin Muhazzab juzu'i na 2 shafi na 3741, Yace: "Duk wanda ya
aikata haka haqiqa ya aikata zunubi babba, abokanmu da wasunsu suka ce duk wanda
ya halatta saduwa da mai haila to ana yi masa hukunci da kafirci"
Haqiqa an halatta agare shi (godiya ta tabbata ga ALLAH) Ya aikata abunda zai karya
masa sha'awa amma banda jima'i kamar sumbanta ko matsewa ko rungumar inda ba
farji ba. Abinda yafi kyau shine kada ya rungumi abunda yake tsakanin cibiya da gwuiwa
sai ta bayan zani, saboda fadin Aisha (R.A) cewa: "Manzon ALLAH (Sallallahu alaihi
wasallam) Ya kasance yana umurtata na daura zani sai ya rungume ni alhali ina haila"
[Bukhari da Muslim]
HUKUNCI NA BAKWAI, SAKI:Ya haramta ga miji ya saki matarsa a halin tana cikin
haila. Saboda fadin ALLAH Ta'ala: "Ya kai wannan Annabi idan zaku saki mataye ku sake
su da iddarsu" [suratul Dalaq aya ta 4]
wato acikin halin da suke fuskantar idda abun sani sakin baya kasancewa sai idan ya
sake ta tana da ciki ko kuma tsarki ba tare da (sake) jima'i da ita ba. Idan kuma ya sake
ta tana cikin haila to bata fuskantar idda domin haila da aka saketa acikinta ba'a
qidayata acikin idda. Haka kuma idan aka saki mai tsarki bayan an sake yin jima'i da ita
to itama iddar da take fuskanta ba abun sani bace, domin ita ba a sani ba ko ta dauki ciki
daga wannan jima'i ta zama mai ciki ko kuma bata dauki ciki ba, tunda babu tabbas daga
wannan nau'i na idda saki ya haramta a gare shi har sai al'amari ya bayyana (daga
wannan shakka da ake ciki).
Sakin mai haila alhalin tana cikin haila haramun ne saboda ayar data gabata, da kuma
abunda ya tabbata cikin sahihai guda biyu da wasunsu daga hadisin Dan Umar cewa: shi
ya saki matarsa alhalin tana haila sai Umar ya bawa Manzon ALLAH (Sallahu alaihi
wasallam) labari da haka sai Manzon ALLAH yayi takaicin abun yace: "Ka umurce shi ya
mayar da ita sannan ya cigaba da zama da ita har sao tayi tsarki sannan tayi haila
sannan tayi tsarki, sannan idan yaso ya cigaba da zama da ita bayan haka, idan kuma
yaso ya saketa kafin ya sake saduwa da ita" wannan ita ce iddar da ALLAH yayi umurni
da a saki mata acikinta.
Da ace mutum zai saki matarsa tana haila ya sa6awa ALLAH kuna ya zama dole ya tuba
ga ALLAH, kuma ya sake dawo da matarsa don ya mata saki irin na shari'ah, wanda ya
dace da umurnin ALLAH da Manzon Sa (Sallahu alaihi wasallam). Ya qyale ta bayan ya
mayar da ita har sai tayi tsarki daga hailar da ya saketa acikinta sannan ta sake yin wata
hailar sannan idan tayi tsarki, in yaso ya cigaba da zama da ita.
Sai dai ana tsare Haramcin Saki acikin haka ga MAS'ALOLI GUDA UKU:
MAS'ALA TA FARKO: Idan Sakin ya kasance kafin kadaita da ita ko kafin saduwa da
ita to babu laifi ya saketa alhalin tana haila, sannan kuma babu idda akanta, saboda haka
bai sa6awa shari'a ki fadin ALLAH Ta'ala " ku sake su ga iddarsu" ba [suratul dalaq aya ta
4]
MAS'ALA TA BIYU: Idan hailar ya kasance tana da ciki to bayanin sababin wannan ya
gabata.
MAS'ALA TA UKU: Idan Sakin ya kasance akan mayarwa (wato mace ta nemi mijinta
ya saketa ta hanyar mayar masa da sadakinsa) to babu laifi ya saketa a halin tana haila,
Misali an samu sa6anin rashin jindadi a tsakanin ma'aurata sai mijin ya kar6i musayar
sadakinsa don ya saketa, ya halatta koda tana cikin haila ne.
Saboda Hadisin Ibn Abbas (R.A) cewa: "Matar thabit bn Qais bn shammas tazo wajen
Manzon ALLAH (Sallallahu alaihi wasallam) tace: "Ya Manzon ALLAH Haqiqa ni bana
zarginsa acikin addininsa ko dabi'unsa sai dai ina tsoron kafirci acikun musulunci" Sai
Manzon ALLAH (Sallallahu alaihi wasallam) Yace: "Zaki mayar masa da gonarsa" sai
tace: "Eh" sai Manzon ALLAH yace: "Kar6i gonarka ka saketa" [Bukhari ne Ya ruwaito shi]
Anan Manzon ALLAH (Sallallahu alaihi wasallam) bai tambaya ba cewa tana haila ne ko
tana tsarki, saboda wannan saki ne da mace ta fanshi kanta. Don haka wannan ya
halatta yayin da aka buqace Shi a kowani hali ya kasance.
Ya fada acikin Littafin Al-Muguniy [Juz'I na 7 shafi na 52] yana mai kawo larurar halaccin
yin (shine mace ta nemi mijinta ya saketa ta hanyar mayar KHUL'I masa da sadakinsa) a
halin haila: Domin abunda yake hana yin Saki acikin haila shine: Larurar da ake gamuwa
da ita da tsayin lokacin idda.
KHUL'I kuwa ana yinsa ne saboda gusar da larurar dake gamuwa da ita sakamakon
rashin kyakykyawan zama a tsakanin Ma'aurata da za na qiyayya da tsana, wannan shine
mafi girma daga larurar tsayin idda, saboda haka ya halatta ayi amfani da qaramar larura
dan a gusar da babbanta. Wannan shine abunda yasa Annabi (Sallallahu alaihi wasallam)
bai tambayi mai KHUL'I game da halin da take ciki ba.
Amma daura aure ga Mace mai haila babu laifi saboda asali shine halacci, babu wani
dalili a bisa hani gare shi, sai dai shigar mijin gareta alhalin tana haila shine abun
dubawa, Idan an aminta bazai sadu da ita ba to babu komai, amma Idan ba haka ba
bazai shiga wurinta ba har sai tayi tsarki, saboda tsoron fadawa cikin abunda aka hana.
HUKUNCI NA 8, QIYASIN IDDAR SAKI DA JININ HAILA: Idan mutum ya saki
matarsa bayan ya shafeta ko ya kadaita da ita, ya wajaba agareta tayi idda da haila uku
cikakkiya idan tana cikin masu haila kuma bata da ciki. Saboda fadin ALLAH Ta'ala:
"Masu ciki ajalinsu (gama iddarsu) shine su haife cikinsu" [Suratul Baqara aya ta 22]
Idan kuma ta kasance daga wadanda basa yin haila kamar qaramar yarinya wacce bata
fara yin haila ba,bl ko wacce ta daina yin haila saboda tsufa ko wacce aka yiwa aiki aka
cire mahaifarta ko wanin wannan saga wacce ba a zaton dawowar hailarta, to iddarta
shine wata uku, saboda fadin ALLAH Ta'ala: "Wadanda suka yanke tsammani daga haila
daga matanku, idan kunyi shakka to iddarsu wata uku ce da wadanda ba suyi haila ba"
[Suratul dalaq aya ta 4]
Idan tana cikin ma'abota haila sai dai hailarta ta dauke saboda wani sababi da aka sani
kamar rashin lafiya ko shayarwa to haqiqa ita zata zauna acikin iddah komai tsayin
lokaci har sai haila ta dawo mata tayi iddah, idan kuma sababin ya wuce hailar bata
dawo ba duk da cewa ta samu sauqi daga rashin lafiyar ko kuma ta gama shayarwa,
kuma hailar ta cigaba da daukewa, to ita zatayi iddar shekara cikakkiya bayan gushewar
sababin wannan shine qauli (magana) mafi inganci wanda ya ginu akan qa'idojin
shari'ah.
Haqiqa idan sababin ya gushe kuma hailar ta ta dauke ba tare da wani sababi abin sani
ba, to ita zata yi iddar shekara cikakkiya, wata Tara (9) na ciki domin shine mafi yawan
lokacin ciki, da wata uku kuma na idda.
Amma idan sakin ya kasance bayan daurin aure kafin shafa da ke6ewa to babu wata
idda acikinsa ko da haila ko babu. Saboda fadin ALLAH Ta'ala: "Yaku wadanda kuka yi
imani idan kun auri mata muminai sannan kuka sake su gabannin ku shafe su, to baku
da wata idda da zaku lissafa akansu" [Suratul Ahzab aya ta 49]
HUKUNCI NA 9, HUKUNCIN KUBUTAR MAHAIFA: wato kadaitar ta daga ciki,
wannan ana buqatuwa izuwa gare shi duk sanda aka buqaci hukunci da ku6utar mahaifa,
yana da mas'aloli: Daga cikinta akwai cewa, idan mutum ya mutu ya bar mace to abunda
yake cikinta zai gaje shi, ita mai mijin haqiqa mijinta bazai sadu da ita ba (ta dau ciki) har
sai tayi haila ko cikinta ya bayyana, idan cikinta ya bayyana sai muyi hukunci da bashi
gado saboda samuwar cikinsa yayin mutuwar wanda zai gada, idan kuma tayi haila sai
muyi hukunci da rashin bashi gado saboda hukuncin mu da ku6utar mahaifa saboda
hailar da tayi (ya nuna bata da ciki).
HUKUNCI NA 10, WAJABCIN WANKA: wanka ya wajaba ga mai haila idan tayi tsarki
tayi wanka don tsarkake dukkan jikinta saboda fadin Annabi (Sallallahu alaihi wasallam)
ga Fadimatu Bintu Abu-Hubaish: "Idan hailarki ta gabato sai ki bar sallah idan kuma ta
bada baya sai kiyi wanka kuma kiyi sallah" [Bukhari ne ya ruwaito]
Mafi qarancin wajibi acikin wanka shine ta gama baki dayan jikinta har abunda yake
qarqashin gashinta, amma abunda yafi shine ya kasance a bisa siffar abunda yazo ciki
Hadith daga Annabi (Sallallahu alaihi wasallam) Yace: "Dayarku ta samo ruwanta da
magaryarta sai tayi tsarki ta kyautata tsarkinta, sannan ta zuba ruwa a kanta ta cuccuda
shi cuccudawa sosai, har sai ruwan ya game baki dayan kanta, sannan ta zuba ruwa a
jikinta baki daya, sannan ta samu wani yanki na auduga tasa turaren miski tayi tsarki
dashi. Sai Asma'u tace: Ya zanyi tsarki da ita? Sai Manzon ALLAH (sallallahu alaihi
wasallam) Yace: "Subhanallahi" sai Aisha (R.A) tace: kibi gurbin jinin (ki shafa)" [Muslim
ya ruwaito]
WAJABCIN WANKA: Bai zama wajibi a warware kitson gashin kai ba, sai dai idan ya
kasance an d'aure shi ne tamau ta yadda ana ganin ruwa bazai sadu da asalinsa ba,
saboda abunda yake cikin Sahih Muslim daga hadisin Ummu Salma (RA) ta tambayi
Manzon ALLAH (SAW) tace: "Ni Mace ce mai yawan kitse gashin kaina shin zan warware
shi ne saboda wankan janaba, a wata ruwayar "Saboda wankan haila da na janaba" sai
yace : A'A kawai ma idan kika zuba ruwa sau uku a kanki ya isheki sannan ki kwara ruwa
a baki d'ayan jiki kiyi tsarki."
Idan mai haila tayi tsarki a lokacin sallah to ya wajaba agareta tayi gaggawar yin wanka
don ta riski sallah akan lokacinta, idan kuma tana cikin tafiya ne kuma bata da ruwa, ko
kuma tana da ruwan amma tana tsoron cutuwa idan tayi aiki (wanka) dashi ko kuma ta
kasance maras lafiya yin amfani da ruwan zai cutar da ita, to sai tayi taimama

CIKIN ABUNDA KE KETOWA GA MAI HAILA (JINI)
Abunda ke qetowa ga mai haila nau'o'i ne:
NA FARKO: Kari ko Ragi, misali: ya kasance al'adar mace shine kwana 6, sai jini ya zarce
mata har kwana 7 sai tayi tsarki a kwana 6.
NA BIYU: Gabata ko Jinqiri, misali: ta kasance tana fara haila a qarshen wata sai ta
ganta a farkonsa, ko ta kasance a al'adarta tana (fara yin haila) a farkon wata sai ta
ganta a qarshensa.
Haqiqa ma'abota ilimi sunyi sa6ani acikin hukuncin wadannan nau'o'i, abin da yake
dai-dai shine duk sanda taga jini to ita mai haila ce, kuma duk sanda tayi tsarki to ita mai
tsarki ce, ko ta samu qari acikin al'adarta ko ragi, haka kuma ko ta gabata kota jinqirta.
Haqiqa an ambaci dalili a bisa haka a cikin fasalin da ya gabata (inda mai shar'antawa

face acikin haqqin mai istahadha kawai.
NAU'I NA UKU: Fatsi-fatsi ko ja-ja ta yadda zata ga jini fatsi fatsi kamar jinin rauni ko

(Ibn Hajar) ya fada acikin sharhinsa ga 'Fat'hul bari' yana nuni da wannan zuwa ga hada
tsakanin Hadisin Aisha (R.A) wanda ya gabata acikin fadinta: "har sai kinga qassa fari"
da Hadisin Ummu Adiyya da cewa Hadisin Aisha yana daukar cewa: ai idan taga jaja-jaja
far-fari ko jaja-jaja baqi-baqi acikin kwanakin haila, amma a wanin kwanakinta sai ki
aikata abunda ummu Adiyya tace.
Hadisin Aisha (R.A) wanda yayi nuni zuwa gare Shi shine Bukhari yayi Ta'aliqinsa yana
mai gabatar dashi kafin wannan babi cewa: "Lallai mata sun kasance suna aika mata da
tsumman da suka goga cikin farjinsu dashi don ta gani ko akwai sauran jinin Haila a jikin
(tsumman) sai tace: kada kuyi gaggawa har sai kunga qassa fara.
KASSA FARA: shine wani farin ruwa da mahaifa take turowa yayin yankewar jinin haila.

To haqiqa malamai sunyi sabani a game da wannan tsarki. Shin tsarki ne ko kuwa za'ayi
masa hukuncin haila?
A Mazhabar Shafi'e: shine za'ayi masa hukuncin haila Saboda haka zamo haila. Kuma

fadi ya fadi wanban kuwa idan ba haka ba da idda ta tawaya da kwana biyar da samun
tsarki. Kuma da za'a sanya shi a matsayin samun tsarki da zai zama qunci da tsanani ga
(mace) da yin wanka ko waninsa a duk kwana biyu, qunci kuwa abun cirewa ne daga
cikin wannan shari'ah. Godiya ta tabbata ga ALLAH.
A Mazhabar Hambaliya shine cewa: Daukewar jinin haila tsarki ne, sai dai idan dukkansa
ya wuce kwanakin haila. Sai wanda ya wuce din ya zana istahadha (jinin cuta).
An fada acikin MUGHNIY [Na 1 shafi na 355] cewa: yana yiwuwa yankewar jini duk sanda
ya tawaya da wuni guda to ba tsarki bane, gini a bisa ruwayar da muka haqalto a game
da nifasi cewa ita ba zata waiwaya ga abunda yake qasa da wuni ba. Wannan shine
sahihi inshaa ALLAHU, domin cewa shi jini yana gudana a wata marra kuma ya dauke.
Saboda haka akwai tsanani cikin wajabta wanka ga wacce take samun tsarki sa'a bayan
sa'a.
Shi kuwa (kunci) abun korewa ne da fadin ALLAH (SWT): "Kuma bai sanya akanku qunci
acikin addini ba" [suratul Hajji aya ta 78]
Yace a bisa wannan yankewar jini baya kasancewa kasa da wunin samun tsarki, sai dai
idan taga abunda yake shiryarwa agare shi. Misali: "ya kasance yankewarsa a qarshen
al'adarta taga farin ruwa"
Zancen ma'abocin littafin ALMUGHNIY yana iya zama tsaka-tsaki a tsakanin wadannan
zantuka guda biyu, amma ALLAH shine magi sanin daidai.
NAU'I NA BIYAR: Bushewar jini ta yadda mace zata ganshi ba danye ba, wannan idan
ya kasance acikin haila ko ya sadu da ita kafin tsarki to wannan haila ne, idan kuma
bayan tsarki ne to ba haila bane, domin matuqar halinsa (jinin haila) shine ya gamu da
jaja-jaja fari-fari da baqi baqi wannan shine hukuncinta.

A SHARI'A: shine jini da yake faruwa ga mace na dabi'a ba tare da wani sababi ba acikin
wasu sanannun lokuta. Shine jini na dabi'a ( mai zubowa) ba tare da wani sababi na
rashin lafiya ba ko rauni ko zubewar ciki ko haihuwa ba.
Saboda cewa shi jinine na dabi'a don haka yana sabawa gwargodon halin mace da
yanayin tasowarta da tsufanta, saboda haka mata suna sassa6awa a cikinsa sassabawa
mabanbanta na zahiri.
HIKIMA A CIKINSA: yayin da dan tayi ya kasance acikin mahaifiyarsa bazai yuwu ya
ringa yin kalaci da irin abunda mutum na wajen ciki yake yin kalaci dashi ba. Kuma bazai
yuwu ga wanda yafi kowa tausayinsa ba ya iya sadar da kalaci gare shi (ta kowace hanya
ba) saboda haka sai ALLAH (SWT) ya sanya jijiyoyin jini acikin mace wanda ta hanyar
sune dan tayin da yake cikin mahaifiyarsa zai dinga yin kalaci acikin mahaifiyarsa ta
hanyar cibiya jinin zai dinga shiga ta jijiyoyin d'an cikin yayi kalaci dashi. Tsarki ya
tabbata ga ALLAH mafi kyawun masu halitta.
Wannan shine Hikimar wannan saboda haka idan mace ta HAILA dauki ciki sai haila ta
yanke mata sai 'yan kadan ne ke yin Haila idan suna da ciki haka kuma masu shayarwa
kadan ne ake samun wacce take yin Haila a cikinsu, musamman a farkon lokacin

ACIKIN NIFASI (JININ HAIHUWA) DA HUKUNCINSA.
NIFASI: shine jinin da mahaifa take sakowa saboda haihuwa ko a lokacin haihuwa ko

(abisa cewa nifasi ne) ba tare da komawa ba." [An naqalto daga gare shi cikin sharhin
Iqna'i]
HUKUNCIN NIFASI
Hukuncin Nifasi kamar hukunci haila ne dai-dai da dai-dai sai dai acikin abubuwan da
zasu zo:
NA FARKO: Iddah ana qiyasi da saki ne bada nifasi ba domin cewa idan saki ya
kasance kafin haihuwa to iddah ya qare da haihuwa bada nifasi ba. Idan kuma saki ya
kasance bayan haihuwa ne to sai ta saurari komowar haila kamar yadda ya gabata.

lokaci idan nifasi ya wucewa mace ba a lissafi ga miji ana qarawa a bisa watanni hudu
gwargodon lokacinsa sa6anin haila shi lokacinsa tana lissafi dashi ga miji.
NA UKU: Balaga tana tabbata da haila bada nifasi ba, domin bazai yuwu ba ga mace ta

yanke kwana 2, sannan (hailar) ta dawo a rana ta 7 data 8 to wannan jinin da ya dawo
haila ce bisa yaqini kuma hukuncin haila ya tabbata agare shi.
Amma shi jinin nifasi idan ya yanke kafin kwana 40 sannan ya dawo a kwana na 40 to
akwai shakka acikinsa, don haka ya wajaba agareta tayi (wanka) tayi sallah tayi azumin
farillah a lokacinsa, kuma abunda ya haramta ga mai haila ya haramta gareta, da
abubuwan da suka wajaba kuma bayan tsarkinta sai ta rama abunda ta aikata shi acikin
wannan jinin irin abunda ya wajaba ga mai haila ta rama shi. Wannan shine mashahuri

idan ba haka ba kuma haila ne.
Wannan shine haqiqan za6in Sheikhul Islam Ibn Taymiyyah, babu wani abu acikin jini
Wanda za ayi qoqonto acikinsa a yadda ake gani sai dai qoqonto abune da ya danganta
mutane suna sa6ani acikinsa gorgodon ilimin su da kuma fahimtar su.
Qur'ani da Hadith akwai bayanin komai acikinsu, ALLAH bai wajabtawa wani mutum yin
azumi ko yin d'awafi sau biyu ba, sai dai idan an samu rauni ana farkon ta yadda baza a
iya riskarsa ba sai an rama.
Amma yayin da bawa ya aikata abunda zai iya aikatawa daga cikin abunda aka kallafa
masa gorgodon iyawarsa to ya ku6utar da zimmarsa, kamar yadda ALLAH (SWT) Yace:
"ALLAH ba ya d'aurawa wata numfashi sai abunda zata iya" [Suratul Baqara aya ta 286]
Kuma Yace: "kuji tsoron ALLAH gwargwadon iyawarku" [Suratul Tagabun aya ta 16]
NA BIYAR: A tsakanin Haila da Nifasi: ita mai haila idan ta samu tsarki kafin cikar
kwanakin da ta saba, to ya halatta mijinta ya sadu da ita ba tare da wani qi ba.
Amma mai Nifasi idan ta samu tsarki kafin kwana 40 to an harkanta mijinta ya sadu da
ita. Amma abunda yake daidai ba a karkanta mijin ya sadu da ita ba, wannan shine
Jamhurun malamai suka fad'a.
Domin kar hanci hukunci ne na shari'ah, kuma acikin wannan mas'alar babu wani dalili na
shari'ah face abunda Imam Ahmad ya ruwaito shi game da matar Uthman Bin Abil Ass
Yace: "Kada ki kusance ni" wannan al'amari baya nuna lazamta karhanci domin yana iya
kasancewa shi yana tsoron cewa ita bata tabbata da samun tsarkinta ba, ko kuma (yana
tsoron) jini yana iya motsawa (ya dawo) mata idan ya sadu da ita da wanin wannan daga
sabbuba. ALLAH Shine mafi sani.
FASALI NA BAKWAI
A GAME DA YIN AIKIN DA YAKE HANA ZUBAR HAILA KO YAKE JAWOTA, DA
ABUNDA YAKE HANA DAUKAN CIKI KO ZUBAR DASHI.
Mace tayi aiki da abunda zai hana zuwan hailarta ya halatta bisa sharrud'a guda biyu:
Na Farko: Ya zamo bata tsoron cutuwa akanta. Amma idan tana tsoron cutuwa to bai
halatta ba saboda fad'in ALLAH (SWT): "Kada ku jefa kawunanku ga hallaka" [suratul
Baqara aya ta 195]
Kuma fad'insa (SWT): "Kada Ku kashe kawunanku lallai ALLAH mai tausayi ne gare Ku"
[Suratul Nisa'i aya ta 29]
Na Biyu: Ya kasance da izinin mijinta idan rataya dashi ya kasance agare shi, kamar ya
kasance mai al'ada ce daga gare shi a bisa fuskar da take wajabta ciyarwarsa agareta
sai tayi amfani da abunda yake hana yin haila don lokaci yayi tsayi kuma ya qara
ciyarwarsa agare ta. To a irin wannan bsi halatta tayi amfani da abunda zai hanata yin
haila ba sai da izininsa. Haka kuma idan ya tabbata cewa hana yin hailar zai hana d'aukar
ciki to babu makawa sai an samu izinin miji sannan ya halatta. Amma abunda yafi shine
kada tayi aiki dashi, sai idan buqatar hakan ta zama dole, domin Barin d'abia bisa yadda
take shine yafi kusa da tabbatar lafiya da ku6uta.
Amma yin aiki da abunda yake jawo Haila shima ya halatta bisa sharrud'a guda biyu:
Na Farko: kada tayi amfani dashi don ta sarayar da wajibi. Misali tayi amfani dashi kusa
da (shigowar watan) Ramadan don taci abinci (acikin watan) ko don ta sarayar da sallah
dashi ko makamancin wannan.
Na Biyu: Ya kasance da izinin miji domin samuwar haila tana hana shi samun jindadi
cikakke (da matarsa) don haka baya halatta tayi aiki da abunda zai hana shi samun
haqqinsa, face sai da yardarsa, idan kuma wacce aka sake ce to acikinsa akwai saryar
da haqqin miji na komawarta idan yana (buqatar) mayar da ita.
Amma yin aiki da abunda yake hana d'aukar ciki yana bisa nau'i biyu:
Na Farko: idan Ya zamanto ya hana d'aukarsa hanawa mai zarcewa to wannan baya
halatta domin yana yanke ciki kuma yana qaranta nasaba kuma ya sa6awa manufar
Ubangiji ta yawaita al'ummar musulmi, duk (mai yin haka) ya aminta da kashe 'yayan
(wannan al'umma) wanda aka nufi samarwa ta hanyar samar da matan da basa haihuwa.
Na Biyu: Ya zamanto ya hana daukar sa zuwa wani lokaci. Misali mace ce mai yawan
d'aukar ciki kuma d'aukar cikin yana wahalar da ita, to ya wajaba ta tsara yadda zata
ringa d'aukan ciki a duk shekaru biyu ko makamancin haka, kuma ya halatta da sharad'in
mijinta ne yayi izinin haka kuma idan yin hakan bazai cutar da ita ba.
Dalilin wannan shine Sahabbai sun kasance suna yin AZALU da matayen su don kada su
d'auki ciki, kuma Annabi (Sallallahu Alaihi Wasallam) bai hana su ba.
AZALU Shine mutum yayi jima'i da matarsa amma sai ya cire (zakarinsa a yayin inzali
sai maniyyinsa ya zuba a wajen farjin (matarsa)

kasance bayan an busa masa rai ne to haramun ne ba tare da wani qoqonto ba, domin
yin haka kashe rai ne wanda ya haramta akashe ba tare da wani haqqi ba.
Kashe rai wanda aka haramta, haramun ne acikin Qur'ani da Sunnah da ijma'in malamai,
idan kuma kafin a busa masa rai ne to haqiqa malamai sunyi sa6ani acikin halaccinsa,
daga cikinsu akwai wanda ya halatta daga ciki kuma akwai wanda suka hana, daga ciki

HALAYYAR MASU ISTAHADA (JININ CUTA)
ISTAHADA TANA DA HALAYE GUDA UKU:
HALI NA FARKO: Ya kasance tana da haila abun sani kafin istahada, wannan Rana
komawa ga lokacin hailarta abun sani sai ta zauna acikin hailarta, kuma hukuncin haila
ya tabbata agareta, bayan wannan kuma istahada ne saboda haka hukuncin istahada ya
tabbata agareta.

Yazo a cikin sahihul Muslim cewa Annabi (Sallallahu alaihi wasallam) Yace da Ummu
Habibatu Bintu Jahshin: "ki zauna gwargodon yadda hailarki take tsare ki, sannan kiyi
wanka kiyi sallah, kada ki damu da jinin dake zuwa miki a sannan (bayan tayi tsarkin)
HALI NA BIYU: shine ya zamo bata da haila abun sani kafin istahada, wato ya zamo
istahada ta zarce mata daga farkon abunda ta gani na jini daga farkon al'amarin
(hailarta) wannan zata yi aiki da rarrabewa, sai ya zama hailarta tana rarrabe ta da baqin
jini ko kaurinsa ko wari (ta haka zata fahimci jinin hailarta) wanda hukuncin haila ya
tabbata gareta, wanda ba wannan ba kuwa to jinin istahada ne kuma hukuncin istahada

•A misali na uku mai warin shine hailarta.
Koma bayan wannan kuwa istahada (jinin cuta) ne. Saboda fadin Annabi (Sallallahu
Alaihi wasallam) ga Fadimatu Bintu Abi-hubaish cewa: "Idan jinin haila ya kasance to shi
baqi ne an sanshi, sai ki daina yin sallah idan kuma dayan ya kasance sai kiyi alwala kiyi
sallah, wannan jinin cuta ne" [Abu-dawud da Nasa'i suka ruwaito, Ibn Hibban da Hakim
sun inganta shi]
Wannan hadisi koda yake akwai duba ga sanadinsa da mataninsa, haqiqa malamai sunyi
aiki dashi, kuma shine abunda yafi cancanta fiye da mayar da ita ga al'adar mafi yawan
mata.
HALI NA UKU: shine ya zamo bata da haila abun sani kuma bata rarrabewa ingantacce
wato ya kasance istahada ya zarce mata daga farkon lokacin da taga jini da siffa daya,
ko a bisa siffofi masu canjawa Inda bazai yuwu ya zama haila ba wannan zata yi aiki da
mafi rinjayen al'adar mafi yawan mata, sai hailarta ta zama kwana shida ko bakwai daga

Fadin Manzon ALLAH (Sallallahu alaihi wasallam) kwana shida ko bakwai ba
bayar da za6i bane. (Misali ne kawai dan yin ijtahadi) sai ta duba abunda yafi kusa a halin
ta daga wanda halayenta yayi kama da nata kuma shekarunta yayi kusa da nata haka
kuma mahaifa cikin, abunda yake shine mafi kusa izuwa ga hailarta daga jininta da
makamancin wannan daga qiyasi, idan ya kasance mafi kusa da kwana shida sai ta
Sanya shi kwana shida, idan kuma ya kasance mafi kusa da ya zamo kwana bakwai sai
ta sanya shi kwana bakwai.
Haqiqa wani sababi yana faruwa ga mace Wanda zai wajabta tsarkake jini daga farjinta
kamar yin aiki acikin mahaifa ko cikin waninta, wannan yana bisa nau'o'i biyu:
NA FARKO: Ya zamo cewa ita ba zai yuwu tayi haila ba bayan aikin da akayi mata.
Misali: Aikin ya zamo (kamar) cire mahaifa ne baki daya ko toshe ta yadda bazai yuwu
jini ya zubo daga gareta ba, wannan matar hukuncin istahadha bai hau kanta ba.
Hukuncinta shine hukuncin macen da taga jaja-jaja fari-fari ko jaja-jaja baqi-baqi ko
danye bayan tsarki, ba zata bar sallah ko azumi ba, kuma ba a hana yin jima'i da ita ba,
kuma wanka bai wajaba gareta ba saboda wannan jinin.

Duk jinin da ya zubo bayan wannan bazai cutar da ita ba, saboda fadin Annabi (Sallallahu
alaihi wasallam) ga Fadima Bintu Abu-hubaysh: "ki nisanci sallah a kwanakin hailarki,
sannan kiyi wanka kiyi sallah koda jinin yana diga akan tabarma.
NA UKU: Jima'i- haqiqa malamai sunyi sa6ani acikin halaccinsa idan ba a tsoron
cutuwa da barinsa, abunda yake daidai shine halaccinsa kai tsaye, domin mataye da
yawa kusan guda goma ko fiye da haka sunyi istadha a zamanin Manzon ALLAH
(Sallallahu alaihi wasallam) amma ALLAH da ManzonSa basu hana yin jima'i da su ba.
Bari dai fadin ALLAH (SWT): "Ku nisanci mataye a lokacin haila" [Suratul Baqara aya ta
222]
Dalili ne a bisa cewa baya wajaba a qaurace musu a waninsa, domin sallah tana halatta
gareta idan tana istahadha to jima'i kuwa shine yafi sauqi. Yin qiyasin jima'i da ita da
jima'i da mai haila bai inganta ba, domin ba daidai suke ba, har awajen masu haramtawar
qiyasi baya inganta tare da rabuwa
JININ AL'ADA 002
FASALI NA BIYU
CIKIN ZAMANIN HAILA DA GWARGODONSA.
Zance acikin wannan fasalin yana da matsayi guda 2.
MATSAYI NA FARKO: A cikin shekarun da haila take zuwa acikin su.
MATSAYI NA BIYU: A cikin lokacin Haila.
Amma shekarun da haila tafi rinjaye acikinsu MATSAYI NA FARKO shine: tsakanin
shekara 12 Zuwa shekara 50, amma ana samu sau da yawa mace tana yin haila a kafin
haka ko bayan haka gwargodon halinta da tasowarta da kuma tsufanta. Lallai malamai
sunyi sa6ani akan shin shekarun da haila take zuwa aciki suna da iyaka da aka ayyana ta
yadda mace ba zatayi haila gabanninsu ba ko bayansu. Kuma shin jinin da yake zuwa ga
mace a gabanninsu ko bayansu jinin haila ne ko na cuta? Malamai sunyi sa6ani acikin
wannan.
Darimiy yace: Bayan ya kawo sabanin: dukkan wadannan kuskure ne awajena domai a
baki dayan wannan yana komawa ne izuwa samuwar jinin, duk jinin da ya samu a kowani
hali da shekaru, ya wajaba a sanya shi a matsayin haila. Wallahu a'alamu. (Al-majmu'u

Wannan abunda Darimiy ya fada shine daidai, kuma shine za6in Sheikhul Islam Ibn
Taimiyyah. Wato duk sanda mace taga haila to ita mai haila ce koda bata cika shekara 9
ba ko kuma ta wuce shekara 50. Wannan kuwa saboda ALLAH da Manzonsa (SAW) sun
rataya hukuncin haila ne bisa suwarsa. Kuma ALLAH da Manzonsa (SAW) basu iyakance
wasu ayyanannun shekaru ba game da wannan ya wajaba komawa zuwa sumuwar jinin
wanda aka rataya hukunce hukunce a kansa. Iyakance shi da ayyanannun shekaru yana
buqatar dalili daga Qur'an ko sunnah. Gashi kuwa babu dalili akan haka.
Amma MATSAYI NA BIYU: Shine gwargodon Haila wato gwargodon zamaninta, haqiqa
malamai sunyi sa6ani mai yawa a kusan zantuka guda 6 koma 7.
Ibnul Munzir Yace: "wata jama'a tace: babu wata iyaka ta kwanaki ga mafi qarancin Haila
ko mafi yawanta"sai nace: wannan magana kamar maganar Darimiy ce wacce ta gabata,
haka kuma shine za6in Sheikhul Islam Ibn Taimiyyah kuma shine dai dai domin qur'ani
da sunnah da kuma abunda ake gani yau da gobe, sun nuna hakan.
DALILI NA FARKO: Fadinsa Madaikakin sarki: "kuma suna tambayarka game da jinin
haila kace shi qazantane saboda haka lu nisanci mataye a yayin da suke haila.kada ku
kuaancesu har sai sunyi tsarki" [suratul Baqara aya 222]
Sai ALLAH ya sanya matuqar hana kusantar itace samun tsarki bai sanya matuqar ta
zama tsayin wuni ko dare ko kwana 3 ko kwana 15 ba.
Wannan yayi nuni a bisa cewa bayyanar hukuncin ita ce haila samuwarta da daukewarto
duk sanda aka samu haila to hukuncinta ya tabbata, haka kuma duk sanda mace ta
samu tsarki to hukunsa (jinin hailar) ya gushe.
DALILI NA BIYU: Shine abunda ya tabbata acikin Sahihi Muslim [4/30] cewa: Annabi
(SAW) yace da Aisha sanda haila tazo mata a yayin da tayi haramar umura: "ki aikata duk
abunda mai hajji yake aikatawa sai dai kada kiyi dawafi har sai kinyi tsarki" sai tace: yayin
da ranar Suka tayi sai na samu tsarki" [Al-hadith]
Yazo cikin Sahihul Bukhari cewa:Annabi (SAW) yace da ita:"ki dakata idan kika samu
tsarki sai ki fita zuwa Tam'in"
Sai Manzon ALLAH (SAW) Ya sanya matuqar hanyar shine tsarki bai sanya wani
ayyanannen lokaci ba, wannan shi ya zama dalili abisa cewa lallai hukuncin yana rataya
ne ga samuwar haila da rashinta.
DALILI NA UKU: Lallai wannan tsare-tsare da rarrabewa wanda wasu daga masanan
fiqhu suka ambata a game da wannan mas' alar ba a sameta acikin littafin ALLAH (SWT)
ba ko acikin sunnar Manzon ALLAH (SAW) tare da cewa akwai buqata, larura ta buqatu
zuwa bayaninta kuma da (iyakance lokacin haila) ya kasance daga abunda ya wajaba
akan bayi su fahimce shi su kuma bautawa ALLAH dashi. ALLAH da Manzonsa sun
bayyana ta bayanai na zahiri ga kowa saboda muhimmancin hukunce hukunce da suka
ginu akan haka. Na daga sallah, Azumi, Aure, Saki, gado da waninsu daga hukunce
hukunce, kamar yadda ALLAH da Manzonsa suka bayyana adadin salloli da lokutansu da
ruku'unsu da sujjadarsu, da zakka dukiyarta, nisabinta gwargodonta yadda za'a rabar da
ita, da Azumi yawansa da lokacinsa da Hajji da waninsa, har ladubban cin abinci da abin
sha da ladubban biyan buqata har adadin abin yin tsarkin hoge, zuwa wanin wannan

ko wane abu" [suratul Nahli aya ta 86]
Kuma fadinsa (SWT):" Bai kasance zancen da aka qirqira ba sai dai gaskatawa ne ga
abunda yake gabansa da kuma rarrabe (bayani ga) ko wane abu" [suratul Yusuf aya ta
111]
Yayin da ba a su wannan gwargwajewa da rarrabe su ba a cikin littafon ALLAH da sunnar
Manzon ALLAH (SAW) ya bayyana baza'a karkata agare su ba, kawai ana karkata a bisa
abunda ake qira Haila wanda aka rataya hukunce hukuncen shari'ah ga samuwarta da
rashinta wannan daliline a cikin wannan mas' ala da waninta daga mas' alolin ilimi.
Domin hukunce hukuncen shari'ah basa tabbata sai da dalili daga shari'ah daga littafin
ALLAH ko sunnar Manzon ALLAH (SAW) ko ijma'i sananne ko qiyasi ingantacce.
Sheikul Islam Ibn Taimiyya yace:"acikin qa'idarsa "yana daga wannan sunan Haila wanda
aka rataya hukunce hukunce masu yawa dashi acikin littafin ALLAH da Sunnah ba a
iyakance mafi qarancinsa ko yawansa ko kuma tsarki a tsakanin haila guda biyu tare da
gamuwar jarrabar al'umma da wannan ba, kuma lugga bata rarrabe gwargodo da iyaka
ba, duk wanda ya iyakance haddi acikin wannan to ya sa6awa qur'ani da sunnah" anan
zancensa ya tuqe. [Risala fil asma'allaty allaqas shari'u al'ahkam biha a 35]
DALILI NA 4: I'itibari wato qiyasi da ake buqata, wannan kiwa saboda cewa ALLAH
(SWT) ya bayyana haila da kasancewarta qazanta. Duk sanda aka sami haila to qazanta
ta samu, babu banbanci tsakanin rana ta 2 data 1, kuma babu banbanci tsakanin rana ta
4 data 3, kuma babu banbanco tsakanin rana ta 16 data 15, kuma babu a tsakanin rana
18 da 17, Haila ita ce Haila, Qazanta ita ce Qazanta, ita illa abun samuwa ce acikin
kwanaki 2 a bisa haddi 1, to ta yaya zai inganta a raba tsakanin kwanaki 2 acikin hukunci
tare da daidaitarsu acikin illah? Shin wannan bai sa6awa qiyasi sahihi ba? Shin qiyasi
sahihi bai zamo ya daidaita kwanaki 2 acikin hukunci ba saboda daidaitansu acikin illah?
DALILI NA BIYAR: Sa6awar zantukan malaman hadith da raurawar (zantukansu) lallai
wannan yana nuni a bisa cewa babu wani dalili da ya wajaba a tafi akansa a game da
wannan mas' ala. Sai dai kawI ita hukunce-hukunce ne na ijtihadi (wanda zai iya zama
daidai ko kuskure) bai zama 1 ce tafi cancanta abi ba daga 1.
Makoma a yayin sa6ani itace littafin ALLAH da Sunnah, idan ta bayyana cewa mafi qarfin

guda 2 ba face sai ya za6i mafi sauqinsu matuqar bai zamo sabo ba.

Imam Ahmad (Rahimahullah) yace: Ana sanin mace ta samu ciki ne ta hanyar daukewar
jini. Idan mace mai ciki taga jini idan ya kasance kafin haihuwa ne da zamani kadan
kamar wuni 2 ko 3 tare da shi kuma akwai (ruwa mai yauqi yauqi) to nifasi ne, idan kuma
ya kasance kafin haihuwa ne da zamani mai tsayi ko kuma kafin haihuwa ne da kadan
sai dai babu ruwa mai yauqi-yauqi a tare da shi, to ba nifasi bane. Sai dai abun tambaya

iddarta shine cikin. Saboda haka bai haramta agare shi ya saketa bayan jima'i ba,
sa6anin watanta (da bata da ciki).
